{"id":1846,"date":"2019-08-18T21:35:41","date_gmt":"2019-08-18T21:35:41","guid":{"rendered":"http:\/\/www.arkansasfreedom.net\/?p=1846"},"modified":"2019-08-18T21:35:41","modified_gmt":"2019-08-18T21:35:41","slug":"a-tale-of-two-inmates","status":"publish","type":"post","link":"https:\/\/arkansasfreedom.net\/?p=1846","title":{"rendered":"&#8220;A TALE OF TWO INMATES&#8221;"},"content":{"rendered":"\n<p><strong>Equal justice under the law?&nbsp; How about selective justice under the law?&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; August 18, 2019, <\/strong><\/p>\n\n\n\n<p>Using 2 Fort\nSmith citizens in exploring the legitimacy of the title of this article.<\/p>\n\n\n\n<p>I shall\nbegin with ex-Arkansas State Senator Jake Files who was convicted on 3 counts:\nWIRE FRAUD, MONEY LAUNDERING, BANK FRAUD, including misuse of STATE GENERAL\nIMPROVEMENT FUND (GIF). &nbsp;&nbsp;Taxpayer\nmonies. Those are heavy crimes, perhaps involving $millions?<\/p>\n\n\n\n<p>There are\nsources that maintain he is still under investigation for bribery. $90,000, a\nnumber involved in both cases. <\/p>\n\n\n\n<p>Files had\ndeep-seated relations with the governor of Arkansas, the Fort Smith City Board,\nthe downtown \u201cStakeholders\u201d, and probably others attached to a quid pro quo. <\/p>\n\n\n\n<p>Questions\nhave been asked on multiple occasions to members of the present &amp; past Ft.\nSmith City Board as to who promulgated the idea of a massive softball complex,\nwhy Files (R) and Democrat office holder Lee Webb were selected to construct;\nno bids taken, no oversight, and why was&nbsp;\nLee Webb not tried along with Files? In the end, the complex was\nincomplete, shoddy, and an embarrassment to the entire city government, as well\nas Fort Smith citizens\u2026i.e. incompetence, political inside dealing, unpaid\ncontractors &amp; a plethora of other violations.<\/p>\n\n\n\n<p>The day\nafter the light was shone on Files potential criminal activities, then State\nRep. Matt Pitsch announced that he was honored to serve the Western District as\nthe next State Senator. Obviously, the fix was in between at least Asa\nHutchinson and Matt Pitsch. Pitsch is the legislative Screw for Hutchinson. In\nall likelihood the both formulated a plan for Files to take the fall long\nbefore Files\u2019 news hit the streets. Was former prot\u00e9g\u00e9 &amp; business partner\nof Gov. Hutchinson &amp; now Western District Federal Prosecutor Duane Kees involved?\n<\/p>\n\n\n\n<p>Files bequeathed\nat least a $million Arkansas taxpayer dollars to the planned Marshal\u2019s Museum\nwhich was initially started by Griffin &amp; Sicard as a \u201cprivate enterprise\u201d\nand both echoed, no tax dollars would be used. &nbsp;&nbsp;The county, city and Fed also bequeathed\nGriffin &amp; Sicard\u2019s project with millions of taxpayer dollars.&nbsp; All Money-Changers. <\/p>\n\n\n\n<p>Files\nrecently made a <strong>DEMAND<\/strong> to be\nparoled <strong>IMMEDIATELY. <\/strong>&nbsp;&nbsp;The basis he is using to justify his\nearly-out was praying, reading 70 books (what kind?), written extensively\n(about what?), counseled inmates (on what?), and earned a Master Gardener\ncertificate. Technically, they don\u2019t have paroles in the Federal System. <\/p>\n\n\n\n<p>Coupled to\nthe crimes he was convicted for he is still under investigation, as previously\nnoted, for what is said to be a bribe of $90,000 by a nursing home complex,\nhome office in Fort Smith. Allegedly one of the owners, David Norsworthy is the\nbriber and is walking free. <\/p>\n\n\n\n<p>Now to the second example:\nthe case of Oscar Stilley, a former Fort Smith attorney who was convicted for\nincome tax evasion. The case involved Stilley&#8217;s handling of IOLTA (lawyer&#8217;s\ntrust) money for two clients.&nbsp; One client\nloaned $250,000 to Stilley&#8217;s co-defendant Lindsey Springer out of money in\nStilley&#8217;s IOLTA account.&nbsp; Another\ninvolved $90,000.&nbsp; Both clients testified\nat trial, saying that Stilley did exactly what he was told to do, and that they\nhad no complaints.&nbsp; Stilley had a duty\nunder the Arkansas Rules of Professional Conduct for attorneys, to promptly pay\nout money to the &#8220;person entitled&#8221; to money in his trust\naccount.&nbsp; Stilley simply did what he was\nrequired to do pursuant to attorney ethics, criminal law, and civil law.&nbsp; <\/p>\n\n\n\n<p>His case was remanded to\nTulsa, Oklahoma\u2019s Northern District and given to Judge Claire V. Eagan, who promptly\nrecused herself, followed by the recruiting of a Judge from the Western\nDistrict of Oklahoma, Oklahoma City to handle the case. There were judges\navailable who could handle the case in the Northern District. &nbsp;Eagan did not comply with the requirements for\nreplacing a judge from her district, but rather with an outside Judge. &nbsp;&nbsp;Eagan\nappointed Judge Stephen P. Friot who appears to be the DOJ\u2019s hitman. Judge\nFriot has demonstrated, in other cases, a willingness to &#8220;scab over&#8221;\nthe government&#8217;s defective cases, and &#8220;pull the government&#8217;s case out of\nthe ditch.&#8221;&nbsp; In Stilley&#8217;s own case,\nFriot acted without a government motion to strike Stilley&#8217;s post trial motion\nand brief, proving that the guilty verdict was necessarily invalid.&nbsp; He refused to order the production of the\ntrial transcript in time to allow Stilley to prepare an appeal on trial issues,\nsaying that Stilley hadn&#8217;t been sentenced yet.&nbsp;\nAt sentencing Friot sent Stilley to jail immediately, over Stilley&#8217;s\nprotest that this would destroy his ability to appeal.&nbsp; Stilley has been held without being allowed\nhis one direct appeal, for over 9 years.&nbsp;\nTrue to his history and background, he has abused his authority to\ndeprive a criminal defendant of <strong>DUE\nPROCESS.<\/strong> &nbsp;At this point two\nfederal violations, one by Judge Claire V. Eagan and one by Stephen P. Friot.\nBoth these judges acted to steamroll federal law that disallowed Oscar Stilley\nto defend himself! <\/p>\n\n\n\n<p>Stilley\u2019s\nclient Eddy Patterson gave $90,000 to Bondage Breakers Ministry.&nbsp; The government claimed that Oscar\u2019s co-defendant\nand client Lindsey Springer was the alter-ego of Bondage Breakers\nMinistry.&nbsp; Stilley stated he did not specifically\nrecall who the $90,000 check was made out to.&nbsp;\nStilley further stated, \u201cI just know that Patterson told me to convey\nthe $90,000 and I did!&nbsp; Once more, NONE\nOF THE MONEY WAS OSCAR\u2019S!<\/p>\n\n\n\n<p>Therefore\nthe amount of money involved (gross amount, not tax liability if any).&nbsp; In essence amounted to $340,000. The $250,000\nloan was from Tulsa dentist Pat Turner to Lindsey Springer (nearly all repaid)\nand was the foundation of the 2005 tax evasion charge. <\/p>\n\n\n\n<p>The $90,000\nfrom Eddy Patterson to Bondage Breakers Ministry formed the foundation for the\ntax evasion charge in 2003.&nbsp; <\/p>\n\n\n\n<p>From those\nmodest numbers Judge Stephen P. (Scab-over) Friot decides that Oscar Stilley\nowes the ludicrous sum of $776,280!!!!&nbsp; <\/p>\n\n\n\n<p>Oscar has\ndefended himself and inmates when the prisons violate prison law. For short\nperiods of time in one prison he was allowed to teach a class and it was\noverwhelmingly successful and for that type of conduct he was regularly\ntransferred to other prisons, repeatedly sent to SHU (solitary confinement),\n\u201cshots\u201d, loss of good time and as previously mentioned transferred to other\nprisons, etc. to break his spirit. <\/p>\n\n\n\n<p>President Trump has\ncreated a program, previously referred to, known as the First Step Act of\n2018.&nbsp; It is designed to teach skills to\ninmates and to reduce recidivism.&nbsp;\nStilley has pleaded for permission to donate computers, software,\nsupport, office supplies &#8211; but can&#8217;t even get an answer.&nbsp; Stilley stands ready to teach GED as well as\nadvanced courses &#8211; if the Department of Justice-Federal Bureau of Prisons\n(DOJ-FBOP) is willing to cease its obstructionism.&nbsp; At Yazoo City Low, where Stilley is confined,\nhe can&#8217;t even get access to archaic &#8220;Fusion&#8221; keyboards, with which to\nteach keyboarding and writing skills.&nbsp;\nThe DOJ-FBOP is doing its best to defeat the purposes of the First Step\nAct.<\/p>\n\n\n\n<p>Oscar and a\nnumber of other people have contacted Ms. Brooke Rollins (Assistant to the\nPresident of the Office of American Innovation), who the President appointed as\nChairman of this 1<sup>st<\/sup> Step undertaking.&nbsp; Some have sent documents &amp; descriptions\nof what Oscar could do and is essentially asking to do.&nbsp;&nbsp; Rollins\u2019 office is in the <strong>White House.&nbsp; <\/strong>Oscar and his supporters have not\nreceived one word from Ms. Rollins office pertaining to 1<sup>st<\/sup> or 2<sup>nd<\/sup>\nSteps and Stilley\u2019s masterful teaching abilities.<\/p>\n\n\n\n<p>Oscar\ninforms that there is extreme inmate interest in completion of 1<sup>st<\/sup>\n&amp; 2<sup>nd<\/sup> Steps since they provide points leading to parole, how to\ndeal with outside life when released and more specifically their legal\nrights.&nbsp;&nbsp; However the program priorities\nseem to have been torpedoed. <\/p>\n\n\n\n<p>Excerpts of\nconversations Barbara &amp; I have had with Oscar demonstrate vividly the wide gulf\nthat exists in prison sentencing and law enforcement as you will soon see, all\nreplete with a political protection racket. <\/p>\n\n\n\n<p>According to\nOscar: \u201cThe government refuses access to <strong>my\nown property and rights to property<\/strong> in order to prepare an Appeal\nBrief.&nbsp; They\u2019re not used to people who\ndon\u2019t give up. They thought that repeated trips to SHU (Security Housing Unit),\nand \u201cShots\u201d (negative reports), loss of good time, transfers to other prisons,\netc. would break my spirit.\u201d<\/p>\n\n\n\n<p><strong>\u201cI will never, never, never give up.\nI will fight to the bitter end, regardless.&nbsp;\nI will write my Brief if I have to do it after I get out of prison.<\/strong><\/p>\n\n\n\n<p>My legal\nposition is summed up as follows: If I had been guilty all this time why not\nlet me appeal? Whereupon the circuit panel can write an opinion explaining <strong>TO THE WORLD<\/strong> why my legal\narguments are meritless?&nbsp; If I am not\nguilty, why not let me use my own property and rights to property to advance my\nlegal argument and get a ruling?\u201d<\/p>\n\n\n\n<p><strong>\u201cI REFUSE TO SHOW REMORSE, ASK\nFORGIVENESS, OR CONFESS TO A CRIME I DIDN\u2019T COMMITT. I SEEK JUSTICE NOT MERCY\u201d<\/strong><\/p>\n\n\n\n<p>The point of\nall this are examples of <strong>SELECTIVE\nJUSTICE<\/strong> and the vicious power held &amp; used by the U.S. Dept. of\nJustice, an all too often criminal operation. <\/p>\n\n\n\n<p>Referring\nback to former Arkansas State Ex-Representative &amp; Senator Jake Files is\ndemanding a release from his prison sentence immediately. Is that strong\nlanguage indicating he might squeal?&nbsp; U.S.\nProsecuting Attorney Duane Kees is a close associate of Gov. Asa Hutchinson,\nwhich may have something to do with Files snowflake sentence and a potential\nearly release.&nbsp; File\u2019s web, no pun\nintended, of criminal possibilities continue to expand.&nbsp; Hutchinson\u2019s appointment of Kees as a Federal\nProsecutor may not be unlawful, but certainly is a conflict.<\/p>\n\n\n\n<p>Files has\nwritten a sophomoric 5 page motion based on worship, counseling, receiving a\n\u201cMaster Gardener\u2019s Certification, and reading 70 books and claims, using that\nsilly worn-out expression he \u201ccould make a difference and move forward\u201d. <\/p>\n\n\n\n<p>For Files\u2019\nknown criminal activities while in the Arkansas Legislature, he received\nthrough the political protection racket an 18 month \u201csnowflake\u201d sentence, now\ndemanding to be released after only 1 year served.<\/p>\n\n\n\n<p>Now compare\nOscar Stilley\u2019s criminally corrupt treatment by the U.S. Justice system (DOJ).&nbsp; He was handed a <strong>15 YEAR SENTENCE OF WHICH 10 OF THOSE YEARS HAVE BEEN SERVED, BY\nFEDERAL JUDGES WHO WERE IN VIOLATION OF FEDERAL MANDATES BEGINNING IN TULSA,\nENDING IN OKLA. CITY. THE 15 YEAR SENTENCE IS WHAT IS CRIMINAL.&nbsp; REMEMBER WHAT JUDGE FRIOT SAID, THE CASE\nAGAINST OSCAR WAS DEFECTIVE.<\/strong><\/p>\n\n\n\n<p>The OKC\nDistrict assigned their number one Federal Judge Hitman to assure a conviction,\nno matter the means.&nbsp; As previously\nstated the records are extremely murky and would not allow Oscar his personal\ndocuments involving $250,000 of his client\u2019s money (<strong>not Oscar\u2019s<\/strong>) and a homemade RV.&nbsp;\nLet\u2019s say for explanatory reasons only, that IF Oscar was guilty of the\ncharges &nbsp;against him, &nbsp;an honorable judge and most citizens would\nthink a sentence of 1- 5 years would satisfy even the most fiendish &amp; brutish\nof Federal Judges. Again, OSCAR HAS SERVED 10 YEARS!!<\/p>\n\n\n\n<p>In real time\nthe 2 sentences should be reversed between the whimpering criminal Files and\nthe real man fighting for honor and EQUAL JUSTICE UNDER THE LAW\u2014THAT WOULD BE\nOSCAR STILLEY WHO ALSO LOST HIS FAMILY, HIS LAW LICENSE, HIS HOME, HIS FREEDOM\nAND HIS REPUTATION. All the atrocities\/punishment committed against Oscar are\nuncivilized, as is the case of much of the government. In Oscar\u2019s case, in\naddition to Judge \u201cScab-over\u201d Friot, the real criminal is the DOJ?<\/p>\n\n\n\n<p>Oscar\nrecently filled a case in the Southern District of Mississippi seeking a court\nruling on the issues that DOJ-BOP have dodged for 9 years.&nbsp; The complaint is 69 pages of Trulincs\ndocuments, the exhibits consist of 285 pages.&nbsp;\nThe Feds refuse to give him access to his docket and docket items. <\/p>\n\n\n\n<p>It certainly\nwould be refreshing if Arkansas Senators Boozman &amp; Cotton would respond to\nOscar and the many inquiries made to Boozman &amp; Cotton regarding his sordid\nunjust situation. <\/p>\n\n\n\n<p>A word from\nFounding Father Patrick Henry: <strong>\u201cTHE\nFEDERAL SHERIFF MAY COMMIT WHAT OPPRESSION, MAKE WHAT DISTRESSES HE PLEASES,\nAND RUIN YOU WITH IMPUNITY.
