Local officials who seek<br \/>\nguidance on this issue may contact FAIR\u00e2\u20ac\u2122s legal counsel for detailed<br \/>\ninformation.<o:p><\/o:p><\/span><\/strong><\/span><\/p>\n<h3><span style=\"font-size: 13px; color: black;\"><strong><span>Overview<o:p><\/o:p><\/span><\/strong><\/span><\/h3>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12pt;\"><span style=\"font-size: 13px; color: black;\"><strong><span>In most cases, federal laws that bar illegal aliens from the<br \/>\nUnited States and punish persons who smuggle, shelter, or employ or otherwise<br \/>\nassist illegal aliens can be enforced by local and state police.<\/p>\n<p>State and local law enforcement officials have the general power to<br \/>\ninvestigate and arrest violators of federal immigration statutes without prior<br \/>\nImmigration and Naturalization Service (INS) knowledge or approval, as long as<br \/>\nthey are authorized to enforce federal law in general. Although immigration is<br \/>\na federal matter, local law enforcement departments and personnel are not<br \/>\nrequired to turn a blind eye to any illegal activity including violations of<br \/>\nimmigration law. It is illegal for local governments to prohibit police<br \/>\ncooperation with the INS, and individual officers who report violations are<br \/>\nprotected by law.<\/p>\n<p>Although the Illegal Immigration and Immigrant Responsibility Act (IIRAIRA) of<br \/>\n1996 provied new authority for empowering local law enforcement agencies to<br \/>\nenforce immigration law provisions against aliens illegally in the country,<br \/>\nlocal police were never powerless to act on immigration law violations before<br \/>\nadoption of that legislation. Local police departments have always had the<br \/>\nability to collaborate with the INS in enforcement operations. An example was<br \/>\nlocal cooperation with the INS and the FBI in locating and interviewing foreign<br \/>\nstudents from Middle Eastern countries following the September 11 terrorist<br \/>\nattacks. <\/p>\n<p>In addition, Section 274(c) of the Immigration and Nationality Act (INA), as<br \/>\namended in 1986, authorizes \u00e2\u20ac\u0153&#8230;all other officers whose duty it is to enforce<br \/>\ncriminal laws,\u00e2\u20ac\u009d to arrest persons for smuggling, harboring or transporting<br \/>\nillegal aliens. Furthermore, federal courts had repeatedly affirmed since 1984<br \/>\nthat local police may inquire into immigration violations in the course of a<br \/>\nroutine stop (see e.g., U.S. v. Salinas-Calderon).<o:p><\/o:p><\/span><\/strong><\/span><\/p>\n<h3><span style=\"font-size: 13px; color: black;\"><strong><span>Legal Opinion by<br \/>\nthe Department of Justice Office of Legal Counsel<o:p><\/o:p><\/span><\/strong><\/span><\/h3>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12pt;\"><span style=\"font-size: 13px; color: black;\"><strong><span>In 2002, the Department of Justice&#8217;s Office of Legal Counsel<br \/>\n(OLC) issued an extremely important legal opinion explaining that state and<br \/>\nlocal police officers have the inherent authority to arrest illegal aliens and<br \/>\ntransfer them to federal custody, regardless of whether the aliens have<br \/>\ncommitted criminal or civil violations of immigration law. U.S. Attorney<br \/>\nGeneral John Ashcroft announced the conclusion of that OLC opinion in June<br \/>\n2002. However, the full opinion was only made available to the public as a<br \/>\nresult of a Freedom of Information Act lawsuit. The local arrest authority<br \/>\nrecognized in this opinion is a critical component of immigration enforcement. <a href=\"file:\/\/\/\/\/DocServer\/OLC_Opinion_2002.pdf?docID=1041\">Read the full<br \/>\nopinion<\/a> (PDF).<o:p><\/o:p><\/span><\/strong><\/span><\/p>\n<h3><span style=\"font-size: 13px; color: black;\"><strong><span>FederalLocal<br \/>\nCooperative Agreements \u00c2\u00ad Section 133 of IIRAIRA<o:p><\/o:p><\/span><\/strong><\/span><\/h3>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12pt;\"><span style=\"font-size: 13px; color: black;\"><strong><span>In 1996, Congress made several express grants of immigration<br \/>\nlaw enforcement authority to state and local governments. The most important of<br \/>\nthe legislative actions was contained in IIRIRA \u00c2\u00a7133, which authorized the U.S.<br \/>\nAttorney General (AG) to enter into written cooperative agreements with state<br \/>\nand local governments to accept the services of state officers or employees in<br \/>\nenforcing the INA. Under a \u00e2\u20ac\u02dcSection 133\u00e2\u20ac\u2122 agreement, state and local governments<br \/>\nmay designate officers or employees (\u00e2\u20ac\u0153local officers\u00e2\u20ac\u009d) who will be authorized<br \/>\nto \u00e2\u20ac\u0153perform a function of [a federal] immigration officer in relation to the<br \/>\ninvestigation, apprehension, or detention of aliens in the United States.\u00e2\u20ac\u009d <\/p>\n<p>Upon approval of the cooperative agreement by the AG, the designated local<br \/>\nofficer becomes a limited federal immigration official. The designated local<br \/>\nofficer is subject to the \u00e2\u20ac\u0153direction and supervision of the AG\u00e2\u20ac\u009d while<br \/>\nperforming the immigration enforcement function and, if the written agreement<br \/>\nso specifies, may use federal property and facilities to accomplish that<br \/>\nfunction. While Section 133 emphasizes that the designated officer is not a<br \/>\nfederal employee, agreements created under this section may grant local<br \/>\nofficers all of the powers exercised by federal immigration officers and<br \/>\nprovide that the designated local officers will enjoy federal immunity.<br \/>\nHowever, the local officers must carry out their immigration functions at the<br \/>\nexpense of the state or local government. <\/p>\n<p>Section 133 is an extraordinary grant of authority to state and local<br \/>\ngovernments, because it allows them to tailor their officers\u00e2\u20ac\u2122 authority to<br \/>\nlocal immigration enforcement needs. A state or local government can agree with<br \/>\nthe AG to authorize its law enforcement officers to enforce the INA\u00e2\u20ac\u2122s civil<br \/>\nand\/or criminal provisions without dedicating those officers to full-time<br \/>\nimmigration enforcement. Section 133 clearly contemplates that multiple<br \/>\nofficers could be authorized to perform one or more immigration enforcement<br \/>\nfunctions. Designated officers could continue to perform their state or local<br \/>\nduties. The scope and duration of the officer\u00e2\u20ac\u2122s immigration enforcement authority<br \/>\nis negotiable. <\/p>\n<p>State and local governments will not be able to take advantage of the broad<br \/>\ngrants of authority available under Section 133 unless their laws authorize<br \/>\nstate and local officers to enforce federal laws. Police departments<br \/>\nconsidering whether to seek a Section 133 cooperative agreement should first<br \/>\ndetermine whether existing state and local laws in their jurisdiction already<br \/>\nauthorize their officers to carry out immigration enforcement functions.<o:p><\/o:p><\/span><\/strong><\/span><\/p>\n<h3><span style=\"font-size: 13px; color: black;\"><strong><span>Emergency<br \/>\nConditions \u00c2\u00ad Section 372 of IIRAIRA<o:p><\/o:p><\/span><\/strong><\/span><\/h3>\n<p class=\"MsoNormal\"><span style=\"font-size: 13px; color: black;\"><strong><span>IIRIRA<br \/>\n\u00c2\u00a7 372 amended the INA to give the AG (AG) power to authorize state and local<br \/>\nimmigration enforcement in emergency situations. Under that provision, the AG<br \/>\nmay authorize state or local officers to enforce the INA if the AG determines<br \/>\nthat \u00e2\u20ac\u0153an actual or imminent mass influx of aliens arriving off the coast of the<br \/>\nUnited States, or near a land border, presents urgent circumstances requiring<br \/>\nan immediate Federal response.\u00e2\u20ac\u009d This emergency authorization may grant a state<br \/>\nor local officer \u00e2\u20ac\u0153any of the powers, privileges, or duties\u00e2\u20ac\u009d conferred by the<br \/>\nINA on INS officers. The AG\u00e2\u20ac\u2122s authorization is contingent on the consent of the<br \/>\nhead of the agency or department in which the officer serves, but unlike \u00c2\u00a7133,<br \/>\n\u00c2\u00a7372 does not expressly require the state or local officer\u00e2\u20ac\u2122s enforcement of the<br \/>\nINA to be authorized by state or local law.<br \/>\nUpdated 6\/06<br \/>\n&nbsp;<o:p><\/o:p><\/span><\/strong><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: right;\"><span style=\"font-size: 13px; color: black;\"><strong><em><span>U.S. Code as of: 01\/03\/05<\/span><\/em><span> <o:p><\/o:p><\/span><\/strong><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-size: 13px; color: black;\"><strong><span><a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/ts_search.pl?title=8&amp;sec=1325\">http:\/\/caselaw.lp.findlaw.com\/scripts\/ts_search.pl?title=8&amp;sec=1325<\/a><br \/>\n<br \/>\n&nbsp;<br \/>\nSection 1325. Improper entry by alien<\/span><span> <br \/>\n&nbsp;<br \/>\n&nbsp;&nbsp;&nbsp; (a) Improper time or place; avoidance of examination or<br \/>\ninspection;<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; misrepresentation and concealment of facts<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Any alien who (1) enters or attempts to enter<br \/>\nthe United States<br \/>\n&nbsp;&nbsp;&nbsp; at any time or place other than as designated by immigration<br \/>\n&nbsp;&nbsp;&nbsp; officers, or (2) eludes examination or inspection by<br \/>\nimmigration<br \/>\n&nbsp;&nbsp;&nbsp; officers, or (3) attempts to enter or obtains entry to the<br \/>\nUnited<br \/>\n&nbsp;&nbsp;&nbsp; States by a willfully false or misleading representation or<br \/>\nthe<br \/>\n&nbsp;&nbsp;&nbsp; willful concealment of a material fact, shall, for the first<br \/>\n&nbsp;&nbsp;&nbsp; commission of any such offense, be fined under title 18 or<br \/>\n&nbsp;&nbsp;&nbsp; imprisoned not more than 6 months, or both, and, for a<br \/>\nsubsequent<br \/>\n&nbsp;&nbsp;&nbsp; commission of any such offense, be fined under title 18, or<br \/>\n&nbsp;&nbsp;&nbsp; imprisoned not more than 2 years, or both.<br \/>\n&nbsp;&nbsp;&nbsp; (b) Improper time or place; civil penalties<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Any alien who is apprehended while entering (or<br \/>\nattempting to<br \/>\n&nbsp;&nbsp;&nbsp; enter) the United States at a time or place other than as<br \/>\n&nbsp;&nbsp;&nbsp; designated by immigration officers shall be subject to a<br \/>\ncivil<br \/>\n&nbsp;&nbsp;&nbsp; penalty of &#8211; <br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (1) at least $50 and not more than<br \/>\n$250 for each such entry (or<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; attempted entry); or<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (2) twice the amount specified in<br \/>\nparagraph (1) in the case of<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; an alien who has been previously subject to a<br \/>\ncivil penalty under<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; this subsection.<br \/>\n&nbsp;<br \/>\n&nbsp;&nbsp;&nbsp; Civil penalties under this subsection are in addition to,<br \/>\nand not<br \/>\n&nbsp;&nbsp;&nbsp; in lieu of, any criminal or other civil penalties that may<br \/>\nbe<br \/>\n&nbsp;&nbsp;&nbsp; imposed.<br \/>\n&nbsp;&nbsp;&nbsp; (c) Marriage fraud<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Any individual who knowingly enters into a<br \/>\nmarriage for the<br \/>\n&nbsp;&nbsp;&nbsp; purpose of evading any provision of the immigration laws<br \/>\nshall be<br \/>\n&nbsp;&nbsp;&nbsp; imprisoned for not more than 5 years, or fined not more than<br \/>\n&nbsp;&nbsp;&nbsp; $250,000, or both.<br \/>\n&nbsp;&nbsp;&nbsp; (d) Immigration-related entrepreneurship fraud<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Any individual who knowingly establishes a<br \/>\ncommercial enterprise<br \/>\n&nbsp;&nbsp;&nbsp; for the purpose of evading any provision of the immigration<br \/>\nlaws<br \/>\n&nbsp;&nbsp;&nbsp; shall be imprisoned for not more than 5 years, fined in<br \/>\naccordance<br \/>\n&nbsp;&nbsp;&nbsp; with title 18, or both.<br \/>\n&nbsp;<br \/>\n&nbsp;<br \/>\nTHEN YOU HAVE 287 (g).&nbsp;&nbsp;&nbsp;&nbsp; AD INFINITUM.<\/p>\n<p><o:p><\/o:p><\/span><\/strong><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(Originally posted on 4\/13\/2008 3:15:00 PM) Subject: Citizens demand to know why laws are not being enforced.&nbsp; The silence has been deafening.
