Today a lawsuit was
\nfiled in Sebastian County Circuit Court, Ft. Smith, Ark. against the Ark. State
\nPolice who are producing documents in Spanish and issuing Ark. Driver\u00e2\u20ac\u2122s
\nLicenses to Illegals at taxpayer cost, and in my view, a criminal act by any
\nstandard.<\/font><\/p>\n

 <\/o:p><\/font><\/p>\n

Our litigation will
\nsmoke out the heavy hitters in the Arkansas Friendship Coalition made up of the
\nstate\u00e2\u20ac\u2122s open-borders, cheap labor advocates, i.e. Tyson\u00e2\u20ac\u2122s, Walton\u00e2\u20ac\u2122s, Stephen\u00e2\u20ac\u2122s,
\nAlltel, LULAC, Associated General Contractors, Clinton School of Public
\nService, Catholic\/Jewish\/Protestant Churches, ACLU, Stodola Law Firm\u00e2\u20ac\u00a6to name a
\nfew. Undergirding the aforementioned are the Chambers of Commerce, all involved
\nin destroying our sovereignty, the rule of law, heritage, culture, and standard
\nof living. <\/font><\/p>\n

 <\/o:p><\/font><\/p>\n

The laws are plain,
\nEnglish is the official language of Arkansas and naturalized citizens are
\nrequired to have a reasonable knowledge of English, therefore why the illegal
\nexaction of taxpayers\u00e2\u20ac\u2122 dollars for information printed or spoken in foreign
\nlanguages?  This is another attack on middleclass Arkansans by the elites
\nand ethno-centric organizations who have no regard for the Constitution and the
\nstability of our society.<\/font><\/p>\n

COMPLAINT FOR INJUNCTIVE RELIEF<\/o:p><\/u><\/font><\/p>\n

            <\/span>Comes now the Plaintiff, Joe
\nMcCutchen, and for his cause of action, states:<\/font><\/p>\n

            <\/span>1.         <\/span>At
\nall times material hereto and at the present time, the Plaintiff, Joe McCutchen
\nwas a citizen and resident of Fort
\nSmith<\/st1:City><\/st1:place>, Sebastian County, Arkansas.  <\/span>Plaintiff is presently, and has for many years,
\nbeen a taxpayer in the State of Arkansas<\/st1:place><\/st1:State>.<\/font><\/p>\n

            <\/span>2.         <\/span>The
\nArkansas<\/st1:State> State Police is an agency or division
\nof the State of Arkansas<\/st1:State><\/st1:place>
\ncharged with responsibility for administering driver\u00e2\u20ac\u2122s license examinations,
\namong its other duties.  <\/span>The Arkansas
\nState Police maintains a place of business in Fort Smith<\/st1:place><\/st1:City>, Sebastian County, Arkansas.  <\/span>Venue is proper herein pursuant to Ark.<\/st1:State> Code Ann. \u00c2\u00a7 16-60-105 made applicable by Ark.<\/st1:State> Code Ann. \u00c2\u00a7 16-60-103(3).<\/font><\/p>\n

            <\/span>3.         <\/span>This
\nis a cause of action seeking injunctive relief to enjoin an illegal exaction
\nthat has occurred in the past and continues at the present time.  <\/span>The illegal exaction consists of the unlawful
\nexpenditure of public funds for the printing of driver\u00e2\u20ac\u2122s license instructional
\nmaterials and drivers license examinations in Spanish.  <\/span>This Court has jurisdiction over this matter
\npursuant to Ark. Const. art. 16, \u00c2\u00a7 13.  <\/span>See
\nHoyle v. Faucher<\/em>, 334 Ark.<\/st1:State><\/st1:place>
\n529, 975 S.W.2d 843 (1998).<\/span><\/font><\/p>\n

            <\/span>4.         <\/span>Ark.<\/st1:State> Code Ann. \u00c2\u00a7 1-14-117 mandates that English is the
\nofficial language of the State of Arkansas<\/st1:State><\/st1:place>.<\/font><\/p>\n

            <\/span>5.         <\/span>Ark.<\/st1:State><\/st1:place> Code Ann. \u00c2\u00a7 27-16-704
\nrequires that all persons taking a driver\u00e2\u20ac\u2122s license examination must have the \u00e2\u20ac\u0153ability to read and understand the highway traffic laws of
\nthis state.\u00e2\u20ac\u009d  <\/span>Because the traffic laws of
\nthis State are written in English, all persons taking an examination for a
\ndriver\u00e2\u20ac\u2122s license must show an ability to read and understand the laws in
\nEnglish.<\/o:p><\/span><\/font><\/p>\n

            <\/span>6.         <\/span><\/span>Ark.<\/st1:State>
\nCode Ann. \u00c2\u00a7 27-16-704 prohibits issuing a driver\u00e2\u20ac\u2122s license to any person who
\nmakes an initial application for a license and who is not lawfully within the United States<\/st1:place><\/st1:country-region>.<\/o:p><\/span><\/font><\/p>\n

            <\/span>7.         <\/span>As
\npart of its obligation to administer driver\u00e2\u20ac\u2122s license examinations, the
\nArkansas State Police publishes driver\u00e2\u20ac\u2122s license testing instructional
\nmaterials that contain information necessary to pass the examination. See Ark.<\/st1:place><\/st1:State> Code Ann. \u00c2\u00a7\u00c2\u00a7 27-18-108
\nand 27-18-109.  <\/span>A copy of portions of the
\ninstructional materials are attached hereto, marked as Exhibit A.<\/font><\/p>\n

            <\/span>8.         <\/span>In
\naddition to publishing instructional materials in English, the Arkansas State
\nPolice publishes the instructional materials in Spanish.  <\/span>A copy of portions of the instructional
\nmaterials in Spanish are attached hereto, marked as Exhibit B.<\/font><\/p>\n

            <\/span>9.         <\/span>Publication
\nof the instructional materials in Spanish is at a substantial cost to Arkansas<\/st1:State><\/st1:place>  <\/span>On information and belief, the instructional
\nmaterials cost several thousands of dollars in 2007. taxpayers.<\/font><\/p>\n

            <\/span>10.       <\/span>Publication
\nof the instructional materials in Spanish offends both the explicit provisions
\nand the spirit of Ark. Code Ann. \u00c2\u00a7\u00c2\u00a7 1-14-117, 27-16-704.<\/font><\/p>\n

            <\/span>11.       <\/span>On
\ninformation and belief, the Arkansas State Police is further causing the
\nexamination for drivers licenses in Arkansas<\/st1:State><\/st1:place>
\nto be provided in Spanish.  <\/span>The Arkansas
\nState Police is having to expend taxpayer funds for printing or copying of the
\nexamination in Spanish.  <\/span>Publication and
\ngiving of the examination in Spanish offends both the explicit provisions and
\nthe spirit of Ark. Code Ann. \u00c2\u00a7\u00c2\u00a7 1-14-117, 27-16-704.  <\/span>It further provides a mechanism for issuing
\ndriver\u00e2\u20ac\u2122s licenses to persons who are unqualified to receive licenses pursuant to
\nArk. Code Ann. \u00c2\u00a7 27-16-704.<\/font><\/p>\n

            <\/span>12.       <\/span>As
\na taxpayer, the Plaintiff is entitled to injunctive relief to prevent further
\nuse of taxpayer funds for the publication of both instructional materials and
\nthe driver\u00e2\u20ac\u2122s license examination in Spanish.<\/font><\/p>\n

            <\/span>WHEREFORE, premises considered, the
\nPlaintiff, Joe McCutchen, prays that this Court issue an injunction prohibiting
\nthe Defendant, Arkansas State Police, from using taxpayer funding for the printing
\nand publication of driver\u00e2\u20ac\u2122s license instructional materials and driver\u00e2\u20ac\u2122s license
\nexaminations in Spanish, and for such other relief as is proper.<\/font><\/p>\n
