Green\u00e2\u20ac\u2122s hearing this<br \/>\nweek regarding the illegal alien invasion, I was glad to see you are in touch<br \/>\nwith the Feds regarding Arkansas\u00e2\u20ac\u2122 law giving authority to ASP to pick up<br \/>\nillegals.&nbsp; However; I was not encouraged by your final response, that<br \/>\nanything of a positive nature is not going to happen\u00e2\u20ac\u201dmaintaining the status<br \/>\nquo, which is not acceptable.<\/p>\n<p class=\"MsoNoSpacing\"><o:p>&nbsp;<\/o:p><\/p>\n<p class=\"MsoNoSpacing\">You stated it would cost $118,000 per head to train<br \/>\ntroopers.&nbsp; May I remind you that there is over a billion in revenue<br \/>\nsurplus&nbsp; in the state coffers. <\/p>\n<p class=\"MsoNoSpacing\"><o:p>&nbsp;<\/o:p><\/p>\n<p class=\"MsoNoSpacing\">This morning\u00e2\u20ac\u2122s headline in the Times Record, \u00e2\u20ac\u0153Beebe<br \/>\nunaware of immigration law\u00e2\u20ac\u009d.&nbsp; I\u00e2\u20ac\u2122ll be euphemistic\u00e2\u20ac\u201dthe governor is not<br \/>\ntelling the truth, and as AG, what does that say about Beebe?<\/p>\n<p class=\"MsoNoSpacing\"><o:p>&nbsp;<\/o:p><\/p>\n<p class=\"MsoNoSpacing\">You may not be aware of the Federal Statutes that give<br \/>\nall, I say again, ALL policing agencies the legal responsibility to arrest<br \/>\nillegals as well as all those hiring, transporting, housing, aiding or abetting<br \/>\nillegals and charge them with a felony, accompanied by prison time and hefty<br \/>\nfines.&nbsp; See accompanying copies of the laws. Governor Beebe has been sent<br \/>\ncopies of the laws on at least 3 occasions while he was A.G. <\/p>\n<p class=\"MsoNoSpacing\"><o:p>&nbsp;<\/o:p><\/p>\n<p class=\"MsoNoSpacing\">You have spent a good deal of time in NW Arkansas and<br \/>\nshould be more than aware of the huge cost foisted upon middleclass Arkansans<br \/>\nto subsidize illegals healthcare, welfare, education, penal, etc.&nbsp; At the<br \/>\nsame time it is disconcerting to find out an ASP watch commander in Springdale<br \/>\nstating last year he did think there was a gang presence in NW until his<br \/>\nbrother-in-law was gunned down.&nbsp; Do you think that trooper was in a<br \/>\ntrance?<\/p>\n<p class=\"MsoNoSpacing\"><o:p>&nbsp;<\/o:p><\/p>\n<p class=\"MsoNoSpacing\">In any case Phil, I know you owe your position and some<br \/>\nallegiance to Governor Beebe, but your real responsibility is to protect the<br \/>\ncitizens of Arkansas, not the corporate master puppeteers. Aliens and employers<br \/>\nviolating immigration laws are subject to arrest, detention, and seizure of<br \/>\ntheir vehicles or property. It is equally unlawful to continue to employ an alien knowing<br \/>\nthat the alien is unauthorized to work. Employers may give preference in<br \/>\nrecruitment and hiring to a U.S. citizen over an alien with work authorization<br \/>\nonly where the U.S. citizen is equally or better qualified. It is unlawful to<br \/>\nhire an individual for employment in the United States without complying with<br \/>\nemployment eligibility verification requirements. Requirements include<br \/>\nexamination of identity documents and completion of Form I-9 for every employee<br \/>\nhired. Employers must retain all I-9s, and, with three days&#8217; advance notice,<br \/>\nthe forms must be made available for inspection. Employment includes any<br \/>\nservice or labor performed for any type of remuneration within the United<br \/>\nStates, with the exception of sporadic domestic service by an individual in a<br \/>\nprivate home. Day laborers or other casual workers engaged in any compensated<br \/>\nactivity (with the above exception) are employees for purposes of immigration<br \/>\nlaw. An employer includes an agent or anyone acting directly or indirectly in<br \/>\nthe interest of the employer. For purposes of verfication of authorization to<br \/>\nwork, employer also means an independent contractor, or a contractor other than<br \/>\nthe person using the alien labor. For example, a<br \/>\nnewspaper article stating that ballrooms depend on an illegal alien work force<br \/>\nof dance hostesses was held by the courts to be a reasonable ground for<br \/>\nsuspicion that unlawful conduct had occurred.<o:p><\/o:p><\/span><\/p>\n<p><span style=\"background: rgb(232, 233, 199) none repeat scroll 0% 50%; font-size: 10pt; font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; color: rgb(128, 0, 255); -moz-background-clip: -moz-initial; -moz-background-origin: -moz-initial; -moz-background-inline-policy: -moz-initial;\">IT IS ILLEGAL FOR NONPROFIT OR RELIGIOUS ORGANIZATIONS to<br \/>\nknowingly assist an employer to violate employment sanctions, REGARDLESS OF<br \/>\nCLAIMS THAT THEIR CONVICTIONS REQUIRE THEM TO ASSIST ALIENS. Harboring or<br \/>\naiding illegal aliens is not protected by the First Amendment. The sheltering need not be clandestine, and<br \/>\nharboring covers aliens arrested outdoors, as well as in a building. This<br \/>\nprovision includes harboring an alien who entered the U.S. legally but has<br \/>\nsince lost his legal status.<o:p><\/o:p><\/span><\/p>\n<p><span style=\"background: rgb(232, 233, 199) none repeat scroll 0% 50%; font-size: 10pt; font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; color: rgb(128, 0, 255); -moz-background-clip: -moz-initial; -moz-background-origin: -moz-initial; -moz-background-inline-policy: -moz-initial;\">An employer can be convicted of the felony of harboring<br \/>\nillegal aliens who are his employees if he takes actions in reckless disregard<br \/>\nof their illegal status, such as ordering them to obtain false documents,<br \/>\naltering records, obstructing INS inspections, or taking other actions that<br \/>\nfacilitate the alien&#8217;s illegal employment. Any person who within any 12-month<br \/>\nperiod hires ten or more individuals with actual knowledge that they are<br \/>\nillegal aliens or unauthorized workers is guilty of felony harboring. It is<br \/>\nalso a felony to encourage or induce an alien to come to or reside in the U.S.<br \/>\nknowing or recklessly disregarding the fact that the alien&#8217;s entry or residence<br \/>\nis in violation of the law. This crime applies to any person, rather than just<br \/>\nemployers of illegal aliens. Courts have ruled that &#8220;encouraging&#8221;<br \/>\nincludes counseling illegal aliens to continue working in the U.S. or assisting<br \/>\nthem to complete applications with false statements or obvious errors. The fact<br \/>\nthat the alien is a refugee fleeing persecution is not a defense to this<br \/>\nfelony, since U.S. law and the UN Protocol on Refugees both require that a<br \/>\nrefugee must report to immigration authorities without delay upon entry to the<br \/>\nU.S.<o:p><\/o:p><\/span><\/p>\n<p><span style=\"background: rgb(232, 233, 199) none repeat scroll 0% 50%; font-size: 10pt; font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; color: rgb(128, 0, 255); -moz-background-clip: -moz-initial; -moz-background-origin: -moz-initial; -moz-background-inline-policy: -moz-initial;\">The penalty for felony harboring is a fine and imprisonment<br \/>\nfor up to five years. The penalty for felony alien smuggling is a fine and up<br \/>\nto ten years&#8217; imprisonment. Where the crime causes serious bodily injury or<br \/>\nplaces the life of any person in jeopardy, the penalty is a fine and up to<br \/>\ntwenty years&#8217; imprisonment. If the criminal smuggling or harboring results in<br \/>\nthe death of any person, the penalty can include life imprisonment. Convictions<br \/>\nfor aiding, abetting, or conspiracy to commit alien smuggling or harboring,<br \/>\ncarry the same penalties. Courts can impose consecutive prison sentences for<br \/>\neach alien smuggled or harbored. A court may order a convicted smuggler to pay<br \/>\nrestitution if the alien smuggled qualifies as a victim under the Victim and<br \/>\nWitness Protection Act. Conspiracy to commit crimes of sheltering, harboring,<br \/>\nor employing illegal aliens is a separate federal offense punishable by a fine<br \/>\nof up to $10,000 or five years&#8217; imprisonment.<o:p><\/o:p><\/span><\/p>\n<p><span style=\"background: rgb(232, 233, 199) none repeat scroll 0% 50%; font-size: 10pt; font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; color: rgb(128, 0, 255); -moz-background-clip: -moz-initial; -moz-background-origin: -moz-initial; -moz-background-inline-policy: -moz-initial;\">Enforcement<o:p><\/o:p><\/span><\/p>\n<p><span style=\"background: rgb(232, 233, 199) none repeat scroll 0% 50%; font-size: 10pt; font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; color: rgb(128, 0, 255); -moz-background-clip: -moz-initial; -moz-background-origin: -moz-initial; -moz-background-inline-policy: -moz-initial;\">A person or entity having knowledge of a violation or<br \/>\npotential violation of employer sanctions provisions may submit a signed<br \/>\nwritten complaint to the INS office with jurisdiction over the business or<br \/>\nresidence of the potential violator, whether an employer, employee, or agent.<br \/>\nThe complaint must include the names and addresses of both the complainant and<br \/>\nthe violator, and detailed factual allegations, including date, time, and place<br \/>\nof the potential violation, and the specific conduct alleged to be a violation<br \/>\nof employer sanctions. By regulation, the INS will only investigate third-party<br \/>\ncomplaints that have a reasonable probability of validity. Designated INS<br \/>\nofficers and employees, and all other officers whose duty it is to enforce<br \/>\ncriminal laws, may make an arrest for violation of smuggling or harboring<br \/>\nillegal aliens.<o:p><\/o:p><\/span><\/p>\n<p><span style=\"background: rgb(232, 233, 199) none repeat scroll 0% 50%; font-size: 10pt; font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; color: rgb(128, 0, 255); -moz-background-clip: -moz-initial; -moz-background-origin: -moz-initial; -moz-background-inline-policy: -moz-initial;\">State and local law enforcement officials have the general<br \/>\npower to investigate and arrest violators of federal immigration statutes<br \/>\nwithout prior INS knowledge or approval, as long as they are authorized to do<br \/>\nso by state law. There is no extant federal limitation on this authority. The<br \/>\n1996 immigration control legislation passed by Congress was intended to<br \/>\nencourage states and local agencies to participate in the process of enforcing<br \/>\nfederal immigration laws. Immigration officers and local law enforcement<br \/>\nofficers may detain an individual for a brief warrantless interrogation where<br \/>\ncircumstances create a reasonable suspicion that the individual is illegally<br \/>\npresent in the U.S. Specific facts constituting a reasonable suspicion include<br \/>\nevasive, nervous, or erratic behavior; dress or speech indicating foreign<br \/>\ncitizenship; and presence in an area known to contain a concentration of<br \/>\nillegal aliens. Hispanic appearance alone is not sufficient. Immigration<br \/>\nofficers and police must have a valid warrant or valid employer&#8217;s consent to<br \/>\nenter workplaces or residences. Any vehicle used to transport or harbor illegal<br \/>\naliens, or used as a substantial part of an activity that encourages illegal<br \/>\naliens to come to or reside in the U.S. may be seized by an immigration officer<br \/>\nand is subject to forfeiture. The<br \/>\npattern of racketeering activity is defined as commission of two or more of the<br \/>\nlisted crimes.
