Immigration Foe Says FOI Request

A local illegal immigration opponent has filed suit in Sebastian County Circuit
\nCourt alleging a state agency and its commissioner failed to comply with a
\nFreedom of Information Act request for documents about the Mexican consulate
\nopening in Little Rock today.<\/p>\n

Joe McCutchen, who has in the past participated in the Minuteman Project
\nguarding the U.S.-Mexico border, filed suit Monday against Arkansas
\nRehabilitation Services and Robert P. Trevino in his official capacity as
\ncommissioner of the Arkansas Department of Workforce Education.<\/p>\n

According to his complaint, filed by attorney Sam Sexton III, McCutchen is
\nappealing a denial of rights he said occurred after he requested on March 14
\nthat Trevino provide him with copies of all e-mails and correspondence relating
\nto \u00e2\u20ac\u0153the Mexican Consulate, the Mexican government, any official of the Mexican
\ngovernment or funding of a Mexican consulate or Mexican governmental office\u00e2\u20ac\u009d
\nanywhere in the state that was sent to or from Trevino or anyone employed by
\nArkansas Rehabilitation Services.<\/p>\n

McCutchen specifically requested an \u00e2\u20ac\u0153unredacted version of an e-mail previously
\nsupplied,\u00e2\u20ac\u009d and alternatively requested that he be given access to the records
\nto inspect and copy them himself. <\/o:p><\/span><\/font><\/b><\/p>\n

The complaint states that Trevino
\nresponded with a letter asking him to specifically identify the previously
\nsupplied e-mail.<\/p>\n

\u00e2\u20ac\u0153In reality, Mr. Trevino knew the specific e-mail that was being requested,
\nbecause he had previously met in person with the plaintiff … and supplied a
\nredacted version of the e-mail,\u00e2\u20ac\u009d the complaint states.<\/p>\n

Nonetheless, McCutchen on March 27 identified the documents he requested \u00e2\u20ac\u201d a
\nJuly 21, 2006, e-mail from Trevino to Alice Stewart and an Aug. 8, 2006, e-mail
\nfrom Trevino to Brenda Turner.<\/p>\n

McCutchen\u00e2\u20ac\u2122s complaint includes a copy of the e-mails he said were redacted.
\nStewart and Turner worked for former Gov. Mike Huckabee at the time.<\/p>\n

The July 21 item has several blacked-out portions.<\/p>\n

Under the header \u00e2\u20ac\u0153Consulate Contract,\u00e2\u20ac\u009d a person whose name is blacked out is
\nsaid to have entered into an agreement with Mexico\u00e2\u20ac\u2122s government and someone
\nwhose name is blacked out \u00e2\u20ac\u0153has arranged to purchase the site of the consulate
\non a 20-year note.\u00e2\u20ac\u009d<\/p>\n

The estimated monthly cost of the note is also blacked out.<\/p>\n

McCutchen states in his complaint that Trevino responded to his more-specific
\nrequest with a letter April 6 stating that he was out of the office because of
\nthe death of his father and that he would try to locate the e-mails upon his
\nreturn to work around April 13.<\/p>\n

With the passage of more than 10 days since Trevino\u00e2\u20ac\u2122s expected return and
\nalmost six weeks since the original FOI request, McCutchen states that the
\ndefendants have \u00e2\u20ac\u0153willfully failed to comply with the requirements of the
\nFreedom of Information Act.\u00e2\u20ac\u009d<\/p>\n

McCutchen requests that the court set a hearing within seven days and order the
\ndefendants to produce the requested information.<\/p>\n

He also seeks an assessment of his costs and attorney fees against the
\ndefendants. <\/o:p><\/span><\/font><\/b><\/p>\n
