It is to house about a dozen employees.<\/p>\n<p>Gov. Mike Beebe also emphasized the business contacts the consulate could<br \/>\nfacilitate.<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"line-height: normal;\"><b><font size=\"6\"><span style=\"font-size: 12pt; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">&#8220;Any time you have a foreign<br \/>\ngovernment that chooses your city for a location, it&#8217;s potentially an economic<br \/>\nboost, it&#8217;s certainly a cultural boost and it certainly allows interaction<br \/>\nbetween people that have a kinship to whatever country that might be,&#8221;<br \/>\nBeebe said Friday.<\/p>\n<p>Beebe said he would be out of town Wednesday and unable to attend the opening<br \/>\nceremonies. Lt. Gov. Bill Halter is expected to attend.<\/p>\n<p>The Mexican consul for Arkansas, Andres Chao, who formerly worked in the<br \/>\nconsulate office in New York, did not return calls seeking comment.<\/p>\n<p>Supporters say the consulate not only will provide Arkansas businesses with<br \/>\naccess to Mexico and opportunities to expand their markets, but also will help<br \/>\nto ensure that immigrants from Mexico are in the state legally.<\/p>\n<p>The idea of establishing a Mexican consulate in Arkansas was first discussed by<br \/>\nformer Gov. Mike Huckabee after his trip to Mexico City in 2003.<\/p>\n<p>Last year, Huckabee struck a deal with Mexican officials to house the consular<br \/>\noffice in a state agency office for $1 a year while the consulate facilities<br \/>\nwere being refurbished. At the time, some lawmakers complained the governor<br \/>\nmade the deal without notifying the Legislature.<\/p>\n<p>McCutcheon, whose anti-immigration activism has landed him on a civil rights<br \/>\ngroup&#8217;s watch list, said Friday his radio ads opposing the consulate would run<br \/>\nthrough Wednesday on several Arkansas radio stations in Little Rock and western<br \/>\nArkansas.<\/p>\n<p>He contended the consulate would lead to relaxed immigration laws and open the<br \/>\ndoor to more illegal immigrants, an influx he said would hurt employment<br \/>\nopportunities for middle-class Arkansans.<\/p>\n<p>Arkansas has one of the fastest-growing Hispanic populations in the country and<br \/>\nmore than half of Hispanic immigrants live in the state illegally, according to<br \/>\na recent study commissioned by the Winthrop Rockefeller Foundation.<\/p>\n<p>Another study, by the Pew Hispanic Center, estimated that as many as 50,000<br \/>\nimmigrants lived in Arkansas in 2005.<\/p>\n<p>The Rockefeller study suggested cheap immigrant labor fuels the economic engine<br \/>\nfor the state&#8217;s poultry and meat processing industry and that production would<br \/>\nslide and costs would rise significantly without it.<\/p>\n<p>McCutcheon said last week that he did not know if anti-immigration protesters<br \/>\nwould demonstrate during the consulate grand opening, though several<br \/>\nanti-immigration Web sites posted announcements that protesters would attend<br \/>\nthe event.<\/p>\n<p>McCutcheon and his wife, Barbara, have in the past helped guard the<br \/>\nU.S.-Mexican border as part of the Minuteman Project.<\/p>\n<p>Last year, the Southern Poverty Law Center in Atlanta labeled McCutcheon a<br \/>\n&#8220;nativist,&#8221; or one who thinks immigrants cannot be Americans. Trevi\u00c3\u00b1o or by anyone employed by Arkansas Rehabilitation<br \/>\nServices.&nbsp; This request specifically includes a request for an unredacted<br \/>\nversion of an e-mail previously supplied pursuant to a Freedom of Information<br \/>\nAct Request.\u00e2\u20ac\u009d<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0.5in 10pt; text-align: justify;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 115%;\"><o:p>&nbsp;<\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\">Alternatively, the Plaintiff,<br \/>\nrequested access to the identified public records and reasonable comforts and<br \/>\nfacilities for the full exercise of the right to inspect and copy the<br \/>\nrecords.<span style=\"\">&nbsp; <\/span>The Plaintiff also offered to<br \/>\npay for the copy of records prior to the time that the records were supplied. <o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\"><span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>5.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>On the 21<sup>st<\/sup> day of July,<br \/>\n2007, the Plaintiff, Joe McCutchen, received a letter attached hereto as<br \/>\nExhibit \u00e2\u20ac\u0153B\u00e2\u20ac\u009d, from Robert P. Trevi\u00c3\u00b1o, Commissioner of the Arkansas Department of<br \/>\nWorkforce Education which essentially asserted an inability to produce the<br \/>\nrecords requested because the records were not appropriately identified.<span style=\"\">&nbsp; <\/span>In the letter, Mr. Trevino stated:<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0.5in 10pt; text-align: justify;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 115%;\">\u00e2\u20ac\u0153Your letter references specifically a request for an unredacted version<br \/>\nof an e-mail previously supplied.<span style=\"\">&nbsp; <\/span>In<br \/>\norder to adequately consider your specific request, please identify precisely<br \/>\nthe e-mail you reference.<span style=\"\">&nbsp; <\/span>Once you are<br \/>\nable to provide that information we can confirm the date and time to access the<br \/>\ninformation requested.\u00e2\u20ac\u009d<span style=\"\">&nbsp; <\/span><o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0.5in 10pt; text-align: justify;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 115%;\"><o:p>&nbsp;<\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\"><span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>6.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>In reality, Mr. Trevi\u00c3\u00b1o knew the<br \/>\nspecific e-mail that was being requested because he had previously met in<br \/>\nperson with the Plaintiff, Joe McCutchen, and supplied a redacted version of<br \/>\nthe e-mail.<span style=\"\">&nbsp; <\/span>A copy of the redacted<br \/>\ndocument previously supplied to Plaintiff Joe McCutchen is attached hereto,<br \/>\nmarked as Exhibit \u00e2\u20ac\u0153C\u00e2\u20ac\u009d.<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\"><span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>7.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Plaintiff, Joe McCutchen, was<br \/>\nentitled to be provided with a version of the e-mail that was not<br \/>\nredacted.<span style=\"\">&nbsp; <\/span>No exception exists under the<br \/>\nFreedom of Information Act to producing the requested e-mail.<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\"><span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>8.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>The failure by Robert Trevi\u00c3\u00b1o to<br \/>\nproduce the requested documentation is nothing more than an attempt to delay<br \/>\nthe production of the requested document. However, in a spirit of good faith,<br \/>\nthe Plaintiff sent the document attached hereto as Exhibit \u00e2\u20ac\u0153D\u00e2\u20ac\u009d dated March 27,<br \/>\n2007 in response to the letter from Mr. Trevi\u00c3\u00b1o that is attached hereto as<br \/>\nExhibit \u00e2\u20ac\u0153B.\u00e2\u20ac\u009d<span style=\"\">&nbsp; <\/span>In Exhibit \u00e2\u20ac\u0153D,\u00e2\u20ac\u009d the<br \/>\nPlaintiff said: <o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0.5in 10pt; text-align: justify;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 115%;\">\u00e2\u20ac\u0153I am specifically requesting an unredacted copy of the e-mail of July<br \/>\n21, 2006 from yourself to Alice Stewart and an unredacted copy of the e-mail of<br \/>\nAugust 8, 2006 from yourself to Brenda Turner that includes the reference July<br \/>\n21, 2006 e-mail.\u00e2\u20ac\u009d<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0.5in 10pt; text-align: justify;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 115%;\"><o:p>&nbsp;<\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-indent: 0.5in; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\">9.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Exhibit<br \/>\n\u00e2\u20ac\u0153D\u00e2\u20ac\u009d was sent by certified mail with a return receipt requested.<span style=\"\">&nbsp; <\/span>A copy of the certified mail receipt signed<br \/>\non behalf of Robert Trevi\u00c3\u00b1o is attached hereto, marked as Exhibit \u00e2\u20ac\u0153E,\u00e2\u20ac\u009d and<br \/>\nreflects that Exhibit \u00e2\u20ac\u0153D\u00e2\u20ac\u009d was received by Mr. Trevi\u00c3\u00b1o\u00e2\u20ac\u2122s office on April 3,<br \/>\n2007.<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-indent: 0.5in; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\">10.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>On<br \/>\nApril 6, 2007, Robert Trevi\u00c3\u00b1o sent Plaintiff the letter attached hereto as<br \/>\nExhibit \u00e2\u20ac\u0153F.\u00e2\u20ac\u009d<span style=\"\">&nbsp; <\/span>In that letter, Mr. Trevi\u00c3\u00b1o<br \/>\nstated that he was out of his office due to the sudden death of his father but<br \/>\nthat he would return to work sometime toward the end of the week on April 13,<br \/>\n2007 and would attempt to locate the referenced e-mails.<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-indent: 0.5in; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\">11.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>April<br \/>\n13, 2007 was on a Friday.<span style=\"\">&nbsp; <\/span>Therefore,<br \/>\naccording to Mr. Trevi\u00c3\u00b1o\u00e2\u20ac\u2122s letter, he would have returned to work on April 13,<br \/>\n2007 at the latest.<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-indent: 0.5in; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\">12.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>It<br \/>\nhas now been more than 10 days since April 13, 2007 and no attempt has been<br \/>\nmade by the Defendants to comply with the Freedom of Information Act request<br \/>\nmade by the Plaintiff.<span style=\"\">&nbsp; <\/span>No communication<br \/>\nwhatsoever has been forthcoming regarding the requested information.<span style=\"\">&nbsp; <\/span>Defendants have not suggested that the<br \/>\nrequested documentation is exempt from disclosure.<span style=\"\">&nbsp; <\/span>The documentation has not been produced or<br \/>\nmade available within the time specified by to Ark. Code Ann. \u00c2\u00a7 25-19-205.<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-indent: 0.5in; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\">13.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Although<br \/>\nPlaintiff has been patient in awaiting the documentation specified herein, it<br \/>\nhas now been almost six weeks since the original documentation was<br \/>\nrequested.<span style=\"\">&nbsp; <\/span>The Defendants have willfully<br \/>\nfailed to comply with the requirements of the Freedom of Information Act.<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-indent: 0.5in; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\">14.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Pursuant<br \/>\nto Ark. Code Ann. \u00c2\u00a7 25-19-205, Plaintiff requests that the Court fix a date for<br \/>\na hearing within seven days for this matter to be heard.<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-indent: 0.5in; line-height: 200%;\"><b><font size=\"6\"><span style=\"font-size: 10pt; line-height: 200%;\">15.<span style=\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>The<br \/>\nCourt should order and direct the Defendants to promptly produce the requested<br \/>\ninformation and should assess both the costs of this action and a reasonable<br \/>\nattorney\u00e2\u20ac\u2122s fee against the Defendants for their failure to comply with the<br \/>\nrequirements of the Freedom of Information Act.<o:p><\/o:p><\/span><\/font><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;
