            Re:       Freedom of Information Act Request

 

Dear Dr. Purcell:

 

Pursuant to the Arkansas Freedom of
Information Act (Ark. Code Ann. § 25-19-101), I hereby request copies of the public
records identified below.  I am
requesting copies of the following public documents, in whatever medium the
documents may be maintained (including those maintained only electronically):  a

 

            (a)        all correspondence, e-mails, facsimiles,
letters, memoranda, or other documents sent to Dr. Jim Purcell or the Arkansas
Department of Higher Education which originated from Governor Mike Beebe or
anyone in the office of Governor Mike Beebe at any time on or after January 1,
2008;

 

            (b)        all policies, regulations, rules, and
directives of the Arkansas Department of Higher Education which either allow or
prohibit colleges and universities in Arkansas to charge in-state tuition rates
to persons who are illegal aliens or otherwise who are not lawfully present in
the United States;

           

(c)               
all policies, regulations, rules, and directives of the
Arkansas Department of Higher Education which either allow or prohibit colleges
and universities in Arkansas to admit persons
as students who are either illegal aliens or otherwise who are not lawfully
present in the United States;

 

(d)              
all correspondence from the Arkansas Department of
Higher Education to any college or university within the State of Arkansas,
including any employee thereof, sent at any time after January 1, 2008, which
concerns the admission of, or tuition charged to, persons who are illegal
aliens or otherwise or not lawfully present in the United States;

 

(e)               
all documents and reports of the Arkansas Department of
Higher Education, as well as reports from any individual college or university
within the State of Arkansas, containing statistical data or information
regarding the number of persons enrolled in a college or university within the
State of Arkansas that is either not lawfully present within the United States
or whose social security number was not properly provided to the college or
university attended by such person;

 

(f)               
all documents and reports of the Arkansas Department of
Higher Education, as well as reports from any individual college or university
within the State of Arkansas, which were compiled pursuant to any directive,
demand, policy, or requirement from Governor Mike Beebe (including any person
in Governor Beebe’s office or on his staff) at any time on or after January 1,
2008; and

 

(g)              
containing statistical data or information regarding
the number of persons enrolled in a college or university within the State of
Arkansas that is either not lawfully present within the United States or whose
social security number was not properly provided to the college or university
attended by such person.

 

Please be
advised that I am specifically excluding from this request any documents that
are protected from disclosure by the Family Educational Rights and Privacy Act
of 1974, 20 USC § 1232g.  To the extent
that any document requested herein contains information that is either
privileged from disclosure or the disclosure of which is prohibited by any law,
please redact the portion which is privileged prior to making such document
available to me.

 

The requested
information may be provided to me at the address specified above.  I offer to pay the actual cost of
reproduction, as defined by statute, either in advance of copying or pursuant
to a statement or invoice from you after copying occurs.  If such charge will exceed $100.00, please
notify me in advance of copying.

 

Alternatively,
if you are otherwise unable to comply with this request, I request reasonable
access to the identified public records and reasonable comforts and facilities
for the full exercise of the right to inspect and copy those records.
