Will the 89th Arkansas General Assembly’s legacy be known as the Assemblage that aborted the U.S. Constitution, i.e. Amendment 7 which states in part “The Right of Trial by Jury shall be preserved�
The 7th Amendment, accompanied by 9 other Amendments was ratified December 15, 1791 and came to be known thereafter as the U.S. Bill of Rights. Equally important, all became part of the U.S. Constitution.
The newly minted Arkansas Republican House & Senate majority, at this juncture, can be described as corrosive and inspired by the towering fact that both political brands are attempting to irreversibly tamper with the U.S. Constitution, specifically Amendment 7 of the Bill of Rights which is one of 10 that has served as the very foundation of our republic providing Arkansans and U.S. citizens, if abided by, unfettered freedoms. Said citizens have been comfortable understanding they have a right of trial by a jury of their peers devoid of outside interference, while the Arkansas Republicans are trying to neuter it. The arrogance and lack of Constitutional understanding of these Republicans, but certainly not limited to!
The National & Arkansas Republican majority proffers allegiance to the Constitution while in full view have instituted a frontal debilitating attack on said Constitution and Arkansas citizens in an effort to abort one of our most basic freedoms, trial by jury, which they surreptitiously refer to as “Tort Reformâ€.
What is taking place is simply the sale of our 7th Amendment to the highest bidder. Some of the bidders are: insurance companies; the Arkansas and American Medical Associations; the Chambers of Commerce; the nursing home combines; in-state/out-of-state corporations, and so on. Why? Because they do not want to be held completely accountable for their mistakes/injuries.
All the above are special interests groups and middleclass Arkansans are the ones as usual that the aforementioned elitist groups are proposing to lead to the slaughterhouse.
If this proposed unconstitutional and self-serving act is allowed to reach fruition, one of our most sacrosanct rights will be “snatched†by representatives of the above (specifically our legislators & special interest groups) crafted in back room scurrilous deals and literally will place a predetermined fixed value on our bodies and limbs.
Are Arkansas legislators so arrogant, so stupid, or so constitutionally bankrupt that they dare tamper with one of America’s most sacred documents and offer it for sale to a plethora of corrupt bidders? Has it not dawned on legislators nor do they not care that they and their families’ own 7th Amendment rights will be curtailed?
