Unconstitutionalities and medical malpractice practiced by the Fort Smith city government. October 25, 2014
Residents of Ward 4 held a townhall meeting Thursday night and one of the residents posed the question “Why they voted (city Directors) to fluoridate the city’s drinking water?” City voters have turned down the question of fluoridating city waters on 2 prior occasions and projects the question, why contaminate the country’s best water supply?
At-Large Director Kevin Settle responded “The state passed it, not the Board, so we have to follow state law”. “We actually had an Attorney General’s opinion that said state law overrode what the citizens voted for”. Note that A.G. McDaniel only rendered an opinion.
Accepting A.G. McDaniel’s opinion was a mealy-mouth response by Settle to the equally mealy-mouth opinion by McDaniel. By the way who wrote this unconstitutional & illegal law?
I submit that neither Settle nor McDaniel are demonstrating they fully understand the documents they swore to “uphold & defend”.
Clearly, both of their positions are unconstitutional pertaining to the U.S. & Arkansas State Constitutions. We are a country with a Constitution and Bills of Rights which absolutely define what is and what is not constitutional. Where is the proof that forced mass medicating of Fort Smith residents is in the Constitution?
Laws do not decide for themselves if they are valid.
Law holds value to those who create it, e.g. in this case, Delta Dental (an insurance company) and those Ark. State legislators which accepted money & perks allegedly going to their respective campaign funds for their support of Delta Dental. Another example of unbridled and wholesale vote buying in the Ark. State Legislature.
Did you know the purchase of Sodium Fluoride in medicinal form (liquid & tablet) requires a written prescription from licensed Ark. physicians?
Four things should be immediately addressed in meaningful terms:
1. A declarative statement from the F.S. City Board & the City Manager that they refuse to implement a fluoride mandate.
2. If the state of Arkansas proposes to engage in some sort of force (legal or policing agencies), and they would not dare, but in case they did they would quickly become a national laughing stock.
3. After all, dispensing fluoride on the authority of the F.S. City Government is a violation of national and state law, i.e. practicing medicine without a proper license.
4. Delta Dental (an insurance company) is subsidizing the start-up costs of adding fluoride to the water system. Why? After the start-up Fort Smith taxpayers assume the burgeoning tax liability.
As stated by Director Settle, itappears they are more than willing to go along with the state legislature, no meaningful questions asked, and continue to be a practicing part of the politicians’ & bureaucrats’ protection racket, disregarding the wishes of the citizens.
