Trial by Jury under Arkansas attack

More on the unconstitutional SJR5 by Sen. Eddie Joe Williams & cohorts…the auction begins today.                             April 1, 2013

Will the 89th Arkansas General Assembly’s legacy be known as the Assemblage that aborted the U.S. Constitution, i.e. Amendment 7 which states in part “The Right of Trial by Jury shall be preserved”?

The 7th Amendment, accompanied by 9 other Amendments was ratified December 15, 1791 and came to be known thereafter as the U.S. Bill of Rights.  Equally important, all became part of the U.S. Constitution.

The newly minted Arkansas Republican House & Senate majority, at this juncture, can be described as corrosive and inspired by the towering fact that both political brands are attempting to irreversibly tamper with the U.S. Constitution, specifically Amendment 7 of the Bill of Rights which is one of 10 that has served as the very foundation of our republic providing Arkansans and U.S. citizens, if abided by, unfettered freedoms.  Said citizens have been comfortable understanding they have a right of trial by a jury of their peers devoid of outside interference, while the Arkansas Republicans are trying to neuter it.  The arrogance and lack of Constitutional understanding of these Republicans, but certainly not limited to!

The National & Arkansas Republican majority proffers allegiance to the Constitution while in full view have instituted a frontal debilitating attack on said Constitution and Arkansas citizens in an effort to abort one of our most basic freedoms, trial by jury, which they surreptitiously  refer to as “Tort Reform”.

What is taking place is simply the sale of our 7th Amendment to the highest bidder.  Some of the bidders are: insurance companies; the Arkansas and American Medical Associations; the Chambers of Commerce; the nursing home combines; in-state/out-of-state corporations, and so on. Why?  Because they do not want to be held completely accountable for their mistakes/injuries.

All the above are special interests groups and middleclass Arkansans are the ones as usual that the aforementioned elitist groups are proposing to lead to the slaughterhouse.

If this proposed unconstitutional and self-serving act is allowed to reach fruition, one of our most sacrosanct rights will be “snatched” by representatives of the above (specifically our legislators & special interest groups) crafted in back room scurrilous deals and literally will place a predetermined fixed value on our bodies and limbs.

Are Arkansas legislators so arrogant, so stupid, or so constitutionally bankrupt that they dare tamper with one of America’s most sacred documents and offer it for sale to a plethora of corrupt bidders? Has it not dawned on legislators nor do they not care that they and their families’ own 7th Amendment rights will be curtailed?

As always, follow the lucre $$$.

Attack on 7th Amendment/Trial by Jury

WHO DO YOU WANT DETERMINING THE VALUE OF YOUR LIFE & LIMB—A POLITICIAN OR A JURY TRIAL OF YOUR PEERS?                    March 27, 2013

Whose Constitutional & monetary interests does Senator Eddie Joe Williams (R-Cabot) SJR5 represent—his constituents or the Arkansas Medical Assoc. (AMA), corporate Arkansas, insurance companies, lobbyists, and politicians?

Answer: not his constituents and the rest of Arkansas citizens. What reward does Senator Williams and his ilk expect for their unconstitutional and arrogant sell-outs.  The Senator and some members of the legislature are more than willing to trample on the 7th Amendment of the U.S. Constitution, e.g. profit is their motive in one form or another and denies the right of citizens to receive full benefit of a jury trial by their peers.

Government intervention will allow politicians, big corporations, insurance companies and the AMA to make decisions regarding citizens’ life and limb.  Williams and his accomplices’ position on the matter of the 7th Amendment is indefensible.  Senator Williams would have you believe that he & the aforementioned groups are better qualified to determine the value of your life and limb as opposed to the time-honored citizen jury trial.

What Senator Williams and his acolytes are proposing is nothing more than a back alley abortion by a gang of legislative thugs who are seeking some type of advancement and/or advantage. Believe me the rape they are proposing was not incubated in the Arkansas legislature.

Apparently Senator Eddie Joe Williams’s allegiances do not lie with his constituents and the citizens of Arkansas and lie squarely with money-slobbering entities.
Citizens, is it your wish that Sen. Williams and his power hungry accomplices tell you the value of a severed organ by a physician, the value of a lost eye in a construction accident, etc?

Just imagine what an unholy mess, accompanied the creation of another huge government bureaucracy (more Gov. Control), will result if Senator Eddie Joe Williams gets this bill passed. Think if you will what representatives of the AMA, their legal counsels, insurance companies, captains of industry and their counsels and scurrilous lobbies sitting in a room debating the worth of arms, legs, eyes, brain injuries, etc. of citizens, resulting from physicians errors, machine failures, car crashes, etc. regardless of circumstance.  Remember the above group has debated and set the value of your loss by a predetermined cost/figure for your life and limb and not by a jury of your peers.

What a sordid, scurrilous bunch that are pushing this travesty.  Each of you in league with Williams on SJR5 is a disgrace to society, humanity, and our republic. What a dastardly attack on citizen rights.

P.S. What legislators have a vested interest in SJR5, i.e. relationships with physicians, construction, insurance, or other self-serving entities?

Congressman thinks neo-con war on Iraq JUST & NOBLE!

THE GRAND LIE
Headline: 3/24/13  Fort Smith Times Record, Congressman Tom Cotton: “Iraq war just and noble”.

Congressman Cotton,                        March 25, 2013

In your words define “Just” & “Noble”.

“Congressman says action right in context of available FACTS”.    Cite one fact that suggested Iraq was in any way a danger or threat to the U.S.   Perhaps your ungrounded treacherous statement is a means you are employing to justify your military service in Iraq.

I find it impossible to divorce myself from your abuse of the two beautiful words “Just” & “Noble”.

Tell me what is “Just” & “Noble” about the U.S. military invading a hapless country based on lies, which had been embargoed for decades?  Tell me what is “Just” & “Noble” about the U.S. sustaining 4,486 U.S. military dead and 30,000 wounded? Tell me what is “Just” & “Noble” about the U.S. murdering an estimated 176,000-189,000 innocent Iraqi men, women & children?  What is “Just” & “Noble” about Iraqi prisoners being led around on leashes like dogs at Abu Ghraib without proof of any guilt?  What is “Noble” about U.S. propensity for murder, assassinations, and torture?  The insidious introduction of torture alone has conditioned American society to accept something formerly considered barbaric.

Tell me what is “Just or Noble” about the passage of the Patriot Acts and voted for by every member of Congress save Rep. Ron Paul?  What is “Just & Noble” about using drones to indiscriminately assassinate unknown victims? The individuals controlling the joysticks of the drones are guilty of murder and/or spying.  Please ask Senator Boozman and the rest of the Arkansas delegation what are the purposes of Domestic Drones overflying Arkansas, yes Arkansas?  Other than total destruction of a country, what has been gained? Oh yes, the cost of the conflagration—a mere $ 2.2 TRILLION!

You’re “Just & Noble” barbarism brought us, in addition to the heinous Patriot Acts, the Military Commissions Act, National Defense Authorization Act, all of which have reduced our former preeminent republic to a police state by abolishing Posse Comitatus, Habeas Corpus, and most of the Bill of Rights. While this is being said Homeland Security is purchasing billions of rounds of ammo—for what purpose?

As a newly minted young congressman, by your words you have betrayed American citizens.  Unfortunately your Republican Party is being led by neo-conservatives, i.e. warmongers for power & profit while using young Americans as nothing more than cannon fodder.

It is appropriate that the principals in the Mideast debauchery are named, i.e. Bush, Cheney, Rumsfeld, I. Kristol, Podhoretz, Wolfowitz, Perle, Feith, Libby, Bolton, Abrams, Kagan, Ledeen, W. Kristol, & Gaffney.  Beginning with Irving Kristol, many are dual Israelis, where do you suppose their allegiances lie?

By the way, as a Congressman, have you been on the obligatory trip to Israel to receive your indoctrination and were you a recipient of AIPAC money?

America’s integrity has been destroyed and citizens’ fear has been instilled. As much decorated General Smedley Butler opined…”WAR IS A RACKET!”.

Buffoon Boehner, the Repubs Biden?

Congressman John Boehner
U.S. Capitol
Washington, DC

Speaker Boehner,                            March 17, 2013

If the statements attributed to you, made over the weekend are true, i.e. “absolutely trust President Barack Obama… open with each other…..honest with each other…the U.S. doesn’t have an immediate crisis in terms of debt”.

You sir are either a liar, political buffoon, or an outright traitor to the American people and the Constitution.

With the almost complete transformation (a promise made by Obama) of America from a Republic to a 3rd World garbage heap with open borders, no sane American office holder could possibly make the aforementioned statements regarding support for the Marxist/deconstructionist President Barack Hussein Obama.

The Republican Party has morphed from an alleged small government, constitutional party to the Party of Irrelevance”  (POI)

Congressman Boehner, did you really say all of the above?  If so, will you repudiate them?

Joe McCutchen
Fort Smith, Ark.

P.S.  Speaker Boehner, what is your position on amnesty in any form regarding the 25-35 million illegal Mexicans and OTM’s nesting in our country? (no, not the 12 million spewed by self-serving politicians, all of which have failed to uphold 8 USC, Sections 1325, 1324a, 1324c, & 1644)

The “Gang of Eight” is just that, a GANG.

Anchor Baby Rubio?

To the RNC:                                                                                          March
17, 2013

Daily reports emanating from various branches of the
Republican Party and national media include Senator Marco Rubio as a potential
presidential candidate.

Senator Rubio is an “anchor baby”, not a natural born
American citizen as required by the constitution…please read.

One would tend to believe the Republican Party is trying to
replicate some of the unconstitutional acts of the Democrat Party regarding
elections.

Furthermore; Senator Rubio, in the name of the Republican Party
has put forth a faux plan dedicated to immigration reform.  The plan is nothing more than a straight line
course to amnesty for the 25-35 million illegal Mexicans & OTM’s nesting in
our former preeminent Republic. No, not the lie of 12 million spewed by self-serving
government and media.

Are you, in the Republican power structure foolish or stupid
enough to believe Rubio’s allegiance lies anywhere but fore square in Hispanic
society, precisely whose interest he will and does appeal to in spite of his
flowering talk?

If the Republican Party is to survive, out of necessity it must
divorce itself from such verbiage that came out of Gov. Bobby Jindal’s mouth on
Nov. 19, 2012…”if we want people to like us, we have to like them first”….spoken
like a true 3rd Worlder, and how pathetic.

How about the Constitution and principle?

In-state tuition for illegals…AGAIN!

Will Republicans Cave Again?                        March 12, 2013

Senator Joyce Elliott, Little Rock’s progressive Marxist, introduced Senate bill SB 915 which would allow an illegal alien, upon signing an affidavit with the school stating he or she intends to gain legal status  would gain the ability to be granted the right to instate tuition, a right not granted to out of state American students. While at the same time would create another taxpayer subsidized bureaucracy.

Elliott said Monday that SB 915 is about education, not immigration.  I beg to differ with Sen. Elliott, it is ALL about illegal immigration—the matter of the U.S. Constitution, the rule of law and her sworn obligations to uphold the aforementioned and defend citizens.

The Constitution and the Rule of Law, i.e. 8 USC, Section 1325, 1324a, 1324c, 1644, negate all her specious and unlawful rhetoric re SB 915.

It is noted that Senator Johnny Key (R-Mt. Home) has joined hands with Sen. Elliott (D) in this proposed nefarious legislation. In this regard, members of the Arkansas Legislature, both Houses, should be aware of the criminal activity of former Arkansas Governor Michael Dale Huckabee.  Huckabee violated Article I, Section 10 of the U.S. Constitution by bringing in a Mexican Consulate housed in Little Rock, which has and is serving as a distribution center for illegals.  At that time Huckabee was in league with Elliott in this same instate tuition endeavor.

Senator Key claims to be interested in education since he is economically involved in said vocation. If that is the case, how does he justify his position supporting SB 915 with all the past and current damage that has and is being done to the public education systems in by illegal foreign nationals, via American children’s minds, dollars, indoctrination, and more importantly, a dumbed down curriculum?

November 7th the Republican Party caved and shed all pretenses of being a Constitutional Party in favor of smaller government and governed by the rule of law, e.g. Louisiana Governor Bobby Jindal making the following statement, “The Republicans’ key to attracting more voters should be ‘if we want people to like us, we have to like them first’.”  Therein lies the silliness and lack of substance offered by one of the Republicans’ national leaders.

Senator Elliott should know American citizens should and must be given first and last considerations in all things involving government.  I am disappointed that she is divorcing herself from the black community while throwing her legislative support to part of the 25-35 million illegals nesting in our republic.  No, not the phony 12 million that government hacks espouse.  Her folks last in education, employment, standard of living, and more importantly the breakdown of the black family. She should withdraw SB 915 and support her own American citizens.

It will indeed be interesting to see if Republicans stand straight, uphold their sworn Constitutional duties in defense of Arkansans and American citizens.

Or will the Republicans cave again and continue to be the Party of Irrelevance (POI)?

More assassins in absentia

To the Arkansas Six:                            March 8, 2013
Senator Mark Pryor, Senator John Boozman, Congressmen Tom Cotton, Rick Crawford, Tim Griffin, Steve Womack.

I was sorely disappointed in not seeing any of you aiding in the filibuster conducted by Senator Rand Paul & colleagues.

Why should I be disappointed, 5 0f the 6 of you voted for the criminally inspired National Defense Authorization Act with the exception of Tom Cotton, who was not yet a member of the congressional delegation.

Your legislative support of the NDAA can only be described as heinous. In a word, it allows government, all branches, city police and county sheriffs to track, spy, and assassinate American citizens, most particularly without due process.

Then there is the matter of erasing legal counsel, trial by jury, secret kidnappings, and imprisonment in foreign lands for indeterminate amounts of time.

Your collective conduct is not only unconstitutional but despicable in the most virulent terms.

Five of you are assassins in absentia.

Did any of you read the bill or are you just that tyrannical?

Assassins in Absentia.

Senators John McCain & Lindsay Graham
U.S. Capitol, Washington, DC

Senators,                    March 8, 2013

Your presence in the U.S. Senate is a dark cloud hanging over our Republic.
As proponents of the NDAA, i.e. drones, absent legal representation, indefinite confinements,  etc. etc., along with your fanning the flames for the phony wars on terrorism is despicable and destroying our once preeminent republic.

The idea that Americans are being spied on at your directions unknowingly from the air along with the capacity to assassinate on command is utterly astounding.  Couple this with your insulting remarks directed at Sen. Paul on his efforts to alert Americans of the attacks on freedom/life by drones and the appointment of the murdering/extraordinary rendition John Brennan demonstrates without error you are enemies of American liberty.

What is the present mission that allows 300+ drones to overfly the United States while those numbers are to increase exponentially?

It is difficult to determine which is the more deadly to American society: redistribution of wealth by Democrats or eternal wars for eternal peace by neoconservative Republicans.

Gentlemen, you are assassins in absentia.

Paying for 1/4 million more on welfare will save money??

TO FEED, CLOTHE, WIPE, ENTERTAIN, & TRANSPORT IN PERPETUITY         March 6, 2013

A Second Mathematical Postulate Coming from Arkansas State Government in Two Weeks—a government program that will save money!

The first postulate you may recall came from the mouth of Rep. Greg Leding who postulated that money taken from citizens by force by the federal government and redirected to welfare recipients was defined as part of GDP.

Close on the heels of Rep. Leding’s creation comes a second postulate from Bo Ryall, president of the corporate Arkansas Hospital Association, who stated that the introduction of ¼ million more deadbeats injected into the already burgeoning 870,000 recipients of Medicaid would save Arkansas money by letting the Feds pay for this outrageous deal proposed by Gov. Beebe, the Democrats, and the corporate hospital association, but only for the first three years. It should be noted that the federal government is already $17 TRILLION in debt…pay with what?

A report said that by expanding Medicaid it could save the state $664 million between 2014-2020.  I challenge Gov. Beebe, Bo Ryall, and any other Big Government enthusiast to present any government entity that ever saved money, most particularly Medicaid.

Moving along with this new mathematical postulate, Mr. Ryall opines that with the introduction of another ¼ million welfare deadbeats (legal & illegal) injected into Arkansas society will create between 8,500 & 11,500 new jobs, i.e. government positions.  I would suggest to Mr. Ryall, Gov. Beebe, and other proponents of forced redistribution to take the mean between 8,500 & 11,500 and multiply by $75,000 (avg. government yrly salary) of the aforementioned individuals (expansion of state government paid for by taxpayers), how much of that so-called $664 million savings is left? First, the money for the new jobs is funded by taxpayers, and then they are taxed again by having to subsidize the expansion.

In addition to this faux bloviating by corporate Arkansas & the state government, here comes the copout introduced by the POI (Party of Irrelevance) to show cause why Arkansas producers should pony up more hard earned tax dollars to be dumped into the Never-Never Land—that by a “Consultant” at the rate of $55,000 per month to tell Arkansas lawmakers how to introduce more theft.  Understand that the consultant wallowed in the government trough for decades and that’s his credentials—no friend to the producing citizens, nor is the state legislature.
Do Arkansas legislators ever discuss the big conundrum?  Will the welfare throngs have their hands out in perpetuity? Do the legislators ever discuss between themselves putting an end to their destructive and criminal behavior? Or do they say let the next bunch worry about it? And finally…

Senator Joyce Elliot is playing around with the Right of Eminent Domain, and no good can come from this woman’s meddling with that Right.

New Economic Theory: Adding welfare recipients is good economics!

Representative Greg Leding (D-Fay) and his “New Economic Theories”        February 28, 2013

Ahhh, the benevolent Arkansas State Representative who hails from that Marxist enclave on the Hill.

Rep. Greg Leding is no doubt a soul-mate of the Catholic Bishop Anthony Taylor, the individual who is no respecter of the U.S. Constitution and the Rule of Law, e.g.  the purveyor of Sanctuary Cities and recipient of taxpayer dollars to fund the misnomer “Catholic Charities”.

The Honorable Greg Leding spewed his benevolent new economic equations at a press conference at the Capitol Wednesday.

To begin with Leding stated “Not only is it the right thing to do to get these ¼ million Arkansans access to healthcare, but it is also an economic driver”.  So welfare is an economic driver? Yes, it drives economics into the ground.  Rep. Leding, no disagreement that these folks in all likelihood need healthcare.  These folks do not have a RIGHT to healthcare and the method you are prescribing for attaining their healthcare is immoral, i.e. theft by force from one group for redistribution to another.  You call these potential welfare recipients numbering ¼ million “Arkansans”.  How many in these numbers are illegal Mexicans & OTM’s? As a Catholic, in all likelihood the number of illegals is of no concern to you.

You go on to say, “We’re looking at about $550 million added to our state’s Gross Domestic Product (GDP)”.  Representative Leding is it your belief $550 million stolen from taxpayers and disseminated to non-producers is GDP?  I further call your attention to the fact that the U.S. government does not have $550 million when we the producers are saddled with a $17 TRILLION debt.  In this same vein your view of economics and math is the same immoral fiber that Governor Beebe wallows in, i.e. “if we don’t take the money someone else will”.

Your economic silliness reaches a new high when you are quoted as saying 6,200 new jobs will be created with the acceptance of Obama’s vote-buying thuggery. You are speaking of government positions, not jobs, while increasing the size of state government and placing more economic burdens on the producers.

Rep. Leding you go on to state, with your pretzelized arithmetic; about 2,800 lives will be saved each year. What crystal ball are you using?

Back to Gov. Mike Beebe and his bloviating, “The federal government will pay all costs for the first 3 years”.  Governor, where does the federal government get the money?

Rep. Leding, you have no constitutional or moral authority to grandstand before the state legislature and Arkansas citizens demanding more forced redistribution from the hard-pressed middleclass.  You and your Democrat soul mates are stealing money from Arkansas citizens without their authority.
